Aktuelle forskningsinteresser
English summary
Abstract of project description with the working title “law of local government representation”

In my thesis I want to study the connection between the doctrine of invalidity in civil law (den privatrettslige ugyldighetslære), and the rules for power of agency (fullmaktslæren), and the doctrine of invalidity in the public law related to the rules for legal capacity of representatives (Ultra Vires) (personell kompetanse) in connection with the activities of local government. An important part of this would be to study whether the local governments can be liable if a local authority body is acting outside its authority. Several issues have to be discussed in relation to this, amongst others whether it would be possible to established a rule for authorization (legitimasjonsregel) and in what cases such a rule will apply. Further more it should be studied what requirements to due attention / good faith (aktsomhetskrav – god tro) that has to be expected from the other contracting party and to what extent the local authority can be liable in other ways than through authorization, like for example the so called Norwegian agency theory (organteorien)?. Another issue that will be studied is the question of what range of applicability the local authority act (Kommuneloven), contract act (Avtaleloven) and the public administration act (Forvaltningsloven) have in connection with local government personnel exceeding their authority. Can these acts be applied in parallel, or do each of them have their own area of applicability.

Looking at the case law from the Norwegian Supreme Court (Høyesterett) in general, an authorization rule can be formulated in some cases, but certain requirements have to be fulfilled. One dividing line seems to be between, decisions that involves public use of power (offentlig myndighetsutøvelse) on the one hand, and decisions that only involve management of wealth (disposisjoner over formuesgoder – privatrettslige disposisjoner) on the other hand. In the case of public use of power the consideration for protecting broader public interests is more dominating than in the cases where the focus is directed to the management of wealth only. This can influence the possibility to establish a rule for authorization. Another dividing line can follow the constellations of the parties; - is the possibility of establishing a rule for authorization (legitimasjonsregel) larger if the contracting party of the local government is a private part rather than another government agency? The significance of international law that Norway is committed to has to be studied in relation to the previously mentioned questions. It can for example be that the private party’s expectations are given more extensive protection under these rules than what follows from traditional Norwegian law.
