Decision regarding shipment of waste - notification form NL101221

Dear Sir or Madam 

We refer to notification form NL101221 of 3. of July 2001, and to Council Regulation (EEC) No 259/93 as transposed in the Norwegian Regulation on Transboundary Shipment of Waste. We are pleased to inform you that the Norwegian Pollution Control Authority (SFT), as the competent authority of destination, hereby authorise Taubåtkompaniet AS to carry out the said import of waste.

The following conditions shall apply to the transport:

General terms:

• Unless otherwise specified, the conditions of Council Regulation (EEC) No 259/93 shall apply.
• If any of the conditions set by other competent authorities differ from SFT's conditions, the stricter conditions shall apply.
• This consent is made only in relation to the regulations mentioned above. Other regulations may introduce further restrictions or conditions relating to the transport¹
• All information stated in the notification form NL101221 is binding except that the notifier may use other carriers than the one stated in box 7 of the notification form.
• Waste for disposal shall not be imported if it can be satisfactorily treated in the country of origin.

Consignments:

A copy of this letter and a completed movement/tracking form shall accompany each shipment. The following requirements are issued in accordance with articles 5 and/or 8 of Council Regulation (EEC) No 259/93:

• Numbering - In box 4 of the movement/tracking form, each shipment shall be numbered sequentially, using numbers only, and starting with "1". No other numbering schemes shall be accepted by SFT.
• Notice in advance - A signed copy of the movement/tracking form shall be sent to SFT no later than 3 days prior to each shipment. SFT prefers to receive the document by telefax.
• Declaration of receipt- A copy of the movement/tracking form, signed in box 23 and/or 24 shall be sent to SFT no later than 3 days after the consignee has received the waste shipment. SFT prefers to receive the document by telefax.

Reporting:

• A copy of the movement/tracking form, signed in box 25, shall be sent to SFT as a statement of recycling/final disposal no later than 180 days after the waste shipment has been received by the consignee. SFT prefers to receive the statement by telefax. If the waste cannot be treated within the period of 180 days, SFT shall be contacted as soon as possible.
• Taubåtkompaniet AS shall report the amount of waste imported during each calendar year, stating the notification number, to SFT before 1 February of the following year.

Right to appeal

• The parties affected by this decision may appeal to the Ministry of Environment within three weeks from the date of receipt of this decision. In such cases a letter stating the reasons for the appeal should be sent to SFT.
