Liberal Constitution-Making
By Asgeir S. Eriksen
Abstract The goal of the paper is to theoretically flesh out a representative constitution-making process. It rests upon an initial account of the liberal legitimacy of an action. The next step is to elaborate different theoretical demands, or duties, such a process must heed in order to become legitimate and just and briefly operationalize the ideal conditions. The last, but important, point to be made is the relationship between normative theory and realistic utopia. The argument presented will weigh alternatives originating from modern liberalism, with a goal that everyone should accept, or be able to accept, how authority is organized.
