Legal assistance in asylum cases

The new system for legal assistance entered into force on 1 January 2005.

If the UDI has reached a negative decision in your asylum case, the legal assistance system will provide you with free legal advice without means testing. The number of hours of paid legal assistance varies according to the type of case. In cases where the UDI makes a positive decision, you will be notified of this by the police in the district where you live.

The aim is to provide a lawyer in a location geographically close to the applicant. Lawyers with wide legal expertise and expertise in immigration and asylum law are linked to regional lists. The principle of freedom of choice of lawyer is applied. If you do not have a particular lawyer you wish to use, you will be offered assistance from one of the lawyers participating in the system.

A new feature of the legal assistance system for asylum cases is that assistance and guidance is initially provided by the Norwegian Organisation for Asylum Seekers (NOAS).

Some asylum seekers will also be entitled to free legal advice without means testing in the first instance.

If you want legal assistance in the first instance but do not fall under the exceptions where aid is given without means testing, the ordinary provisions on free legal advice after means testing will apply.
